Work Visas?
At A Filing Service, we offer printed general information for you to determine that the nature of the position and your background are appropriate for the H1B, and let you check alternatives if the initial proposal is not a viable option. Here is just a sample of the visas we can assist you with the documentation in obtaining:


H1B visa allows a foreign worker to enter the U.S. temporarily for the purpose of performing services in a “specialty occupation” for a U.S. employer. The H1B visa classification requires that (1) a foreign national be coming to the U.S. to work temporarily in a “specialty occupation”, (2) that the foreign national have the equivalent of at least a U.S. Bachelor's degree in a field related to that occupation; and (3) that the sponsoring company pay the foreign national the prevailing wage, provide proper notice to its work force, and not be involved in a strike or lockout.


H-3 visa is specifically designed to enable you to train in the U.S. in almost any discipline. USCIS calls this loose classification, 'any field of endeavor'. This includes agriculture, technology, communications and governmental leadership. This loose classification does not include people seeking graduate medical training.


L-1 Intra-company executive/manager: The L-visa allows foreign nationals to legally live and work in the United States Travel in and out of the United States is allowed as long as your L-visa and status are valid Visas are also available for immediate family members (i.e., spouse and children). Spouses may work in the United States under special permission from the immigration service.


O-1 visa is for persons of extraordinary ability. The visa enables people with extraordinary ability in the sciences, arts, education, business, athletics, motion picture or television industry to enter the U.S. for temporary periods of time. To be considered a person of extraordinary ability, you should be considered to be at the top of your field, and can only work in the US in that area of expertise.


P-1 visa is issued to certain entertainers, circus artists, and athletes who wish to work temporarily in the U.S. Outstanding athletes may apply for this visa in order to compete in the U.S., either as individuals or as members of an internationally recognized athletic team. Entertainment groups with an outstanding international reputation can be granted P-1 classification as a unit; however individual entertainers within these groups cannot apply for P-1 visas to perform separate from the group.


R-1 visa enables religious workers to temporarily enter the United States. A religious vocation is defined as a calling to religious life, shown by a demonstration of a lifelong commitment; for instance, taking vows. Nuns, monks, and religious brothers and sisters are examples of religious workers.


TN visa under the North American Free Trade Agreement (NAFTA), certain citizens of Canada and Mexico are eligible to enter the U.S. under the nonimmigrant TN status. The TN Visa enables Canadian and Mexican citizens to temporarily work in U.S. in a NAFTA-approved professional occupation. TN status can be granted for a period of one year. TN status can be renewed annually, as long as the applicant can show that the proposed stay continues to be of a temporary nature.

The following are the requirements to be eligible for the TN Visa:
The profession must be on the NAFTA list.
The foreign national must possess the necessary education or training for that profession.
The proposed position must be classified as a professional position.
The foreign national must work for a U.S. employer.


E3 visa is a United States visa for which only citizens of Australia are eligible. It was created by an Act of Congress in the aftermath of the friendly but tough negotiations on the U.S.-Australia Free Trade Agreement (AUSFTA), although it is not formally a part of the AUSFTA.The legislation creating the E-3 visa was signed into law by President Bush on May 11, 2005.


E-2 Treaty Investor visa is based around treaty agreements America maintains between certain countries. The E2 Visa is issued to the foreign nationals of these treaty countries on the basis the visa holder is entering America for the sole purpose of developing and managing business enterprise with which they have a vested interest in. As such, to qualify for this visa the applicant must have invested or plans to invest in the near future a substantial amount of capital within America. To be eligible, you must:

Provide substantial investment;
Be planning to establish an active business enterprise;
Be in a role which is managerial or supervisory in nature; and the investment must be committed.

Citizenship?
Basic requirements (Based on published information, this is not a legal advise):


• Be a permanent resident continuously for five years, subsequent to LPR status. If married to a U.S. citizen (USC) the residency requirement is only three years, but there are several conditions to the three-year rule (e.g. parties must have been married for at least three years, no legal separation etc.).


• Not be absent from the U.S. for a continuous period of more than one year during the period for which continuous residence is required. Absence of more than six months but less than one year establishes the presumption of not satisfying the continuity of residence requirement, which can be potentially rebutted. If one has broken continuity of residence, s/he may reapply for U.S. citizenship four years and one day following the date of his/her return to the U.S. to resume residency. The spouse of a USC needs two years and one day.

• Be physically present in the U.S. for at least one half of the five years (or one half of the three years, in a case where the spouse is a USC).


• Having the required time within the USCIS district or State

• Having a good moral character. If you have a criminal conviction you need to speak to a lawyer before applying.

• Having sufficient English and U.S. civics knowledge

• Declaring attachment to the U.S. Constitution

Family based residency:


1. Unlimited Immediate Relatives of US Citizens: A spouse, widow or unmarried child under the age or 21 of a US citizen. This category also includes parents of adult US citizens


2. Then there are FOUR preference categories for limited family-based immigration. There could be significant waiting periods before permanent residency is granted in these categories:


• First Preference: Unmarried children over the age of 21 of US citizens • Second Preference: 2A—Spouses of lawful permanent residents, their unmarried children under 21


• Second Preference:

2B—Unmarried sons and daughters of permanent residents who are 21 and older


• Third Preference: Married children of US citizens

Employment Based Green Card?
At A Filing Service, we’ll assist you with the documentation process of permanent residency. You can qualify for residency (green card) through either a close family member, an offer of employment or investment in the U.S. The green card process can take as little as 6 months (for residency through a U.S. citizen spouse) or 4 years (for residency through some employment based categories). This is only an overview of each process. You should review the information to determine the best course for you and your family.


• PERM (labor certification) is the first step to permanent residency in the Eb-2 or Eb-3 categories described below. The Department of Labor (DOL) allows an employer to hire a foreign worker to work permanently in the United States. In most instances, before the U.S. employer can submit an immigration petition to the immigration service, the employer must obtain an approved labor certification request from the DOL's Employment and Training Administration (ETA). The DOL must certify to the USCIS that there are no qualified U.S. workers able, willing, qualified and available to accept the job at the prevailing wage for that occupation in the area of intended employment and that employment of the alien will not adversely affect the wages and working conditions of similarly employed U.S. workers.


Some of the Employment-Based Residency Categories:


EB-1 classification includes: Multinational Executive or Manager of a Company Link to Investment based residency and individuals with extraordinary ability in the arts, sciences, education, business or athletics; to outstanding professors or researchers.


EB-2 classification includes: Professionals with Advanced Degrees or Persons with Exceptional Ability. Applicants are "members of the professions holding advanced degrees or their equivalent" and those "who because of their exceptional ability in the sciences, arts, or business will substantially benefit the national economy, cultural, or educational interests or welfare of the United States."


• EB-3 classification includes: Aliens with at least two years of experience as skilled workers; Professionals with a baccalaureate degree; and other workers with less than two years experience, such as an unskilled worker who can perform labor for which qualified workers are not available in the United States. You should be aware that a long waiting period exists for residency in this category.

Investment Based Residency

Investment based residency
Multinational Executive or Manger of a Company
An executive or manger who, in the three years before filing for residency, has been employed overseas for at least one year by a corporation or other legal entity and who seeks to enter the United States to continue to render services to the same employer, or to a subsidiary or affiliate, in a capacity that is managerial or executive
EB-5 Investment Green Card (Traditional Direct Program)
Permanent Residency/Green Card program.
Investor must purchase or start a Non-Passive Business.
The Investment must be at least $1million or $500,000 in qualifying locations.
Investor must manage the business.
The Investment must create at least 10 new U.S jobs.
Conditional Green Card will be issued to the investor, spouse and children Under 21.
EB-5 Investment Green Card (Regional Center Program)
Regional Centers are Private Businesses that allow multiple investors to assist them in expanding their Business objectives. Regional Centers are generally low in risk and will afford the investor a low return on investment and generally the ability to re-coupe investment in 5 to 6 years.


Permanent Residency/Green Card program.
Investor must generally invest $500,000 into a certified Regional Center.
Management by investor is on a very limited basis and investor does not need to live near location of business.
A Conditional Green Card will be issued to the investor, spouse and children Under 21.
Regional Centers are numerous. There are approximately 50 designated Regional Centers and approximately 50 more that are in the pre-application stage. Regional Centers compete strongly for foreign national investment funds. It is Critical that Investors retain a knowledgeable Law Firm to represent THEM when analyzing the Regional Center Options.

Permanent Residency Through Green Card

Green Card Lottery -
The Diversity Lottery Program allocates 55,000 new immigrant visas each year (usually October through December) for individuals from underrepresented nations. A nation is considered underrepresented if less than 50,000 people from that nation immigrated to the U.S. in the past five years. To be eligible for the Diversity Lottery Program, you should have either a high school education, its equivalent or two years work experience within the last five years in a job, which demands two years training.
You or your spouse must be a native of a nation eligible for the Diversity Lottery Program. You may be eligible if your parent was born in a country eligible to participate in the lottery. The Diversity Lottery Program randomly picks the 55,000 visa candidates. Individuals are chosen to receive the visa by chance, not by merit.
